Specifies m.othersrules for concluding sales contracts through the online store available at: www.Moroccan elixir.pl and contains the most important information about the Seller, the online store, the terms and conditions for placing orders electronically as part of the online store and the rights of the Consumer.

Chapter I Glossary
1.Company / Seller - EMBM Solutions Magdalena Jouhri with its registered office at Kraków, ul.Stawowa 119, 31-346 POLAND.NIP: 6372083824, REGON: 385609211, EU VAT: PL6372083824.
2.Online Store (Store) - a website belonging to the seller available under the domain  www.Moroccan elixir.pl
3.Customer - an entity (including a Consumer) making purchases in the Online Store.
4.Consumer - a customer who is a natural person who makes a legal transaction with EMBM Solutions Magdalena Jouhri not directly related to her business or professional activity, in particular who places an order in the Online Store.
5.Regulations - these regulations.
6.Product / Goods - an item available for sale in the Online Store.
7.Registration - a one-time activity consisting in setting up an account by the Customer, made using the administration panel provided by the Seller on the Store's website.
8.Order fulfillment time - the number of working days in which the order is completed, entrusted to the courier and delivered by courier to the place indicated by the Customer.
9.Working days - days of the week from Monday to Friday, excluding public holidays.
10.Order - the Customer's declaration of will, submitted via the Online Store, specifying: the type and quantity of products in the Online Store's assortment at the time of placing the order, method of payment, method of delivery of the products, place of issue and Customer's data, constituting the Customer's submission of an offer to conclude a contract sale via the Online Store of the products being the subject of the order.

Chapter II General provisions
1.The owner of the Online Store www.Moroccan elixir.pl is Magdalena Jouhri running a business EMBM Solutions Magdalena Jouhri  with its registered office at Kraków, ul.Stawowa 119, 31-346 POLAND, having NIP: 6372083824, REGON: 385609211, EU VAT:PL6372083824, entered to the Central Register and Information on Economic Activity of the Republic of Poland kept by the competent minister d.peconomy.

2.web clientMoroccan elixir.pl undertakes to provide true data and refrain from providing false and unlawful data.Web page.Moroccan elixir.pl is not responsible for failure to deliver messages sent to the e-mail address provided by the user.
3.These Regulations contain the framework provisions of the sales contract concluded via the online store  www.Moroccan elixir.plBefore registering or placing an order, the Customer is obliged to read these Regulations and the Privacy Policy and accept them.
4.Simultaneously with the acceptance of the Regulations, the Customer may give additional consent to the processing of his personal data by the Seller for marketing purposes, in particular to receive commercial information and offers.
5.Information about the features and essential properties of the Products are placed each time with the presented Product and constitute an invitation to conclude an Agreement, within the meaning of Art.71 of the Civil Code, on the terms set out in the Regulations.
6.Using the Online Store means any activity of the Customer that leads to familiarization with the content contained in the Store.
7.To use the Online Store and conclude a sales contract, it is necessary to have the following minimum technical requirements:
a) devices allowing access to the Internet,
b) a web browser to download and display the website,
c) an active account electronic mail (e-mail),
d) enabling the option of saving Cookies and Javascript in the web browser.

Chapter III Placing Orders
1.Customers can place orders in the Online Store using the Order Form using the Customer Account service or as a guest (without registering a Customer Account).
2.The Customer Account service consists in enabling Customers to use the functionality of the Online Store after logging in.The advantages of this service includeothersthe ability to view the history of placed orders, check the status of the order, use discounts and edit customer data.
3.Registration of the Customer Account on the Website is voluntary and free of charge.
4.Registering a Customer Account in the Online Store requires completing the registration form (step 1), clicking the "Create an account" field (step 2) and confirming the willingness to create an Account by clicking the confirmation link sent automatically to the e-mail address provided (step 3).In the Registration Form, it is necessary for the Customer to provide the following data: name and surname/company name, address (street, house/apartment number, zip code, city, country), e-mail address, contact telephone number and password.In the case of Customers who are not consumers, it is also necessary to provide the company name and NIP number.In order to register a Customer Account, it is required for the Customer to read and accept these Regulations.
5.Purchases in the online store can also be made as a guest (without registering a Customer Account), using the function of adding a product to the Cart.
In order to place an order, the Customer should perform at least the following steps, some of which may be repeated many times:
- adding the Product to the basket and indicating their quantity;
- selecting the address for sending the Product and providing data for shipping ;
- selection of the type of delivery;
- selection of the type of payment;
- placing an order in the store by using the "COMPLETE THE ORDER" button.
6.Placing an order is tantamount to concluding a sales contract between the Customer and the Seller.
7.After placing the order, the Customer receives an e-mail automatically generated by the Store with the details of the order and the order number to the provided e-mail account.
8.The customer undertakes to provide true and correct data when placing the order.In the event of providing false data, the Customer shall be liable for the damages incurred by the Seller resulting from this fact.

Chapter IV.Price and delivery costs
1.The subject of the sale are brand new goods, free from defects, presented by the Online Store at the time of placing the order by the Customer.
2.All prices of products presented in the Online Store are expressed in Polish zlotys and are gross prices, i.e.include taxes, including value added tax (VAT).Product prices do not include delivery costs.
3.The binding and final price is the price of the Product given at the time of placing the order, additionally confirmed in the Basket and in the e-mail confirming the order.Information on the total amount to be paid (including the possible Cost of delivery, an additional fee for the COD option, a voluntarily selected Satisfaction Guaranteed service) is presented after the Customer selects the form of delivery of the order and the form of payment.
4.When placing an order, the customer may choose the following method of payment of the price and the cost of delivery of the goods:AND.based in Poznań (then the option of BLIK payment, e-transfer, payment by debit card or credit card is available),
b) cash on delivery
c) by traditional transfer to the Seller's bank account kept in the bank ING Bank Śląski no.: 61 1050 1445 1000 0097 3270 4243.
5.If the Customer chooses the payment method in advance, the Customer undertakes to make the payment within 7 days from the date of placing the order.The day the payment is credited to the Seller's bank account is binding.After this period, the order is cancelled.
6.By making purchases in the Store, the Buyer agrees to receive electronic invoices.

Chapter VDelivery
1.The ordered Product is delivered to the address indicated in the order.
2.Unless otherwise stated in the offer, the delivery time of the Goods is 48 hours.including business days.
3.The seller will proceed to the execution of the order after it has been paid for.
4.Products ordered via the Store are delivered only within the territory of the Republic of Poland using a DHL courier company or by sending to an Inpost Paczkomaty (cost PLN 14).Delivery within Europe is possible by prior arrangement.
5.Shipping costs are payable for each order below PLN 179 in the amount indicated on the order page.
6.In order to ensure trouble-free execution of the order, the Seller provides the appropriate courier company with the Customer's e-mail address and telephone number.Providing an e-mail address and telephone number is a mandatory element of the purchase contract concluded in the Store.

Chapter VI.Right of withdrawal
1.According to Art.27 of the Act of May 30, 2014.on consumer rights (JournalATfrom 2014pos827 with laterdied) A consumer who has concluded a distance contract may withdraw from this contract within 14 days without giving any reason, provided that the goods have not been used.
2.In order to exercise the right of withdrawal, the Customer must inform the Seller of his decision by an unequivocal statement.The statement may be made in writing, e.g.by post or via e-mail.
3.To meet the deadline to withdraw from the contract, it is enough to send information regarding the exercise of the right to withdraw from the contract before the deadline to withdraw from the contract.
4.Each customer's request to withdraw from the contract is considered individually.It should be remembered that most cosmetics are perishable products and opening them may lead to the loss of the expiry date and creates the possibility of infection.Considering the above opening of the cosmetic, e.g.by breaking the seals, it may go beyond ordinary management.The cost of returning the Products to the Store is borne by the Customer.

6.The Customer should attach the original proof of purchase or otherwise document the purchase of the Product.A statement of withdrawal from the contract, in which the exact data and account number to which the refund is to be made must be provided.
7.The customer is not entitled to withdraw from the contract if the subject of the sales contract is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery.
8.In the case of returning the whole or part of the order, which results in the fact that the conditions of the "Free Delivery" promotion are no longer met, the Store reserves the right to deduct the shipping costs of the original order from the amounts due to the Customer in the amount depending on the method of delivery chosen by the Customer.The party incurring the shipping costs in the event of exercising the right to withdraw from the contract is the Customer.
9.In the event of withdrawal from the contract, the Seller will reimburse the Customer for all costs incurred immediately, within 14 days from the date of receipt of information on withdrawal from the contract.The refund is made in the same way as the payment was received by the Seller.The Seller reserves the right to withhold the return until receipt of the Product.
10.Returning the Product to the Store is effective only if the 14-day deadline has been met.The Seller does not bear the cost of returning the Product.
11.The Customer is responsible for the decrease in the value of the item as a result of using the Product in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item.
12.The Seller accepts only and exclusively a Product that is not damaged and is complete.
13.The right to withdraw from the contract by the Consumer is excluded, among others.othersin the case of contracts:
a) in which the subject of the service is an item that deteriorates quickly or has a short shelf life,
b) in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the packaging was opened after delivery;
c) in which the subject of the service are items which after delivery, due to their nature, are inseparably connected with other items;

Chapter VII.Complaint procedure
1.The basis for the complaint is the Store's liability under the warranty for Product defects.In order to assess physical defects, one should in particular rely on the description of the Product placed each time with the presented goods.
2.If the Product has a defect, the Buyer has the right to submit a price reduction statement, may demand removal of the defect, replacement of the Product with a defect-free one or withdrawal from the contract, if the defect is significant.
3.The above warranty rights are only available to Customers who are Consumers.In relations between the Seller and the Customer who is not a Consumer, the warranty for defects is excluded.
4.In order to submit a complaint, the customer may inform the store about it by phone, letter or e-mail.

6.In the event of exercising the rights under the warranty, the Customer is obliged to deliver the defective Product to the Seller.The returned Product should be properly secured for transport and should be accompanied by a proof of purchase.
7.The cost of shipping is borne by the customer.In the event of a positive consideration of the complaint, the Seller reimburses the additional shipping costs incurred by the Customer.
8.Complaints are considered at the latest within 14 days from the date of receipt by the Store of the shipment with the Product under complaint.
9.The Seller is not responsible for the consequences of improper use or storage of the Product.
10.The parties to the contract may use out-of-court means of dealing with complaints and pursuing claims, e.g.through mediation, arbitration or arbitration proceedings.At http://ec.Europe.eu/consumers/odr Customers can find a platform for an online system for settling disputes between consumers and entrepreneurs at the EU level (ODR platform).The ODR platform provides comprehensive services for consumers and entrepreneurs seeking out-of-court settlement of a dispute regarding contractual obligations arising from an online sales contract or service contract.

Chapter VIII Newsletter
1.Using the Newsletter is free and voluntary.
2.The use of the Newsletter takes place after providing the e-mail address in the "Newsletter" tab visible on the Online Store website, to which subsequent editions of the Newsletter are to be sent and clicking the "Subscribe" field.You can also subscribe to the Newsletter by selecting the appropriate box when setting up an Account and completing the order - the Customer is subscribed to the Newsletter.
3.The ordered Newsletter is sent only to the e-mail address provided by the Customer.
4.The customer has the option, at any time and without giving a reason, to unsubscribe from the Newsletter (resignation from the Newsletter) by sending an appropriate request to the Online Store, in particular via e-mail to the following address:  sklep@eliksirmaroka.pl

Chapter IX Final Provisions
1.In the event of invalidity or inability to implement any of the regulations contained in the regulations, the rest of the regulations remain in force.
2.The Seller may change the Regulations.These changes do not affect the Order placed before the date of entry into force of the changes.
3.Any disputes arising from the implementation of the provisions of the Agreement and the Regulations, the parties will first try to settle by agreement.
4.The competent court for settling disputes with Consumers is the local court according to the applicable provisions of the Code of Civil Procedure.
5.Settlement of any disputes arising between the Seller and the Customer who is not a Consumer is submitted to the court competent for the seat of the Seller, which is the District Court in Olkusz.
6.In matters not covered by these Regulations, the provisions of Polish law, in particular the Civil Code and the Act on consumer rights, shall apply.
7.The issues of protection of Customers' personal data are regulated in a separate document: "Privacy Policy".
